DataMon Terms of Service

These terms are an agreement between you and Tinus Christian Creeper ("we", "us"), the maker of DataMon, a virtual pet game for iPhone, iPad and Android ("the app"). By downloading or using DataMon you agree to these terms. If you don't agree, please don't use the app.

1. Who can use DataMon

You may use DataMon if you are old enough to agree to these terms where you live, or if your parent or guardian agrees to them for you. DataMon is rated 9+ on the App Store and is not designed for children under 13 on Google Play. You must also follow the terms of the store you got the app from (the Apple App Store or Google Play).

2. Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to use DataMon on devices you own or control, for your own non-commercial entertainment. You may not:

• copy, sell, rent or redistribute the app, or remove its notices;
• reverse engineer, modify or hack the app or its servers, except where the law allows it;
• use cheats, bots, modified apps or automated tools to gain an advantage, or to change game results, event results, leaderboards or rewards;
• interfere with the DataMon Public Server or try to get around a ban.

3. Free to play, ads and in-game items

• DataMon is free and has no in-app purchases. Nothing in the app can be bought with real money.
• Rewarded ads, provided by Google AdMob, are optional. You can watch one to earn in-game rewards such as Free Shekel, up to a daily limit. Ads are made by advertisers, not by us, and we are not responsible for their content or for the products they offer.
• In-game currencies (such as Shekel and Chef Coins), Pets, items, levels and rewards have no real-world value. They can't be exchanged for money and can't be sold or traded outside the app. They are part of the game and give you a licence to use them in the app only.
• We may change, rebalance, add or remove game features, items, events, prizes and amounts at any time, for example in an update.

4. Online play

Online Battles and online events (such as the World Boss, Mini Bosses, Tournaments, Stage Cups, the Gauntlet and the Bracket Cup) are optional and need an internet connection. When you play online:

• Be respectful. Don't harass, threaten or impersonate other players.
• Your DataPlayer name, level and pictures, and your Pet's name and picture, are shown to other players and on leaderboards.
• The Public Server, events and leaderboards are offered as they are. They may be unavailable at times, and we may change, pause or end them. We try to make results and prizes fair, but they may be corrected if something went wrong.
• Local battles on your own network connect directly between devices. You are responsible for who you connect with.

5. Pictures, names and other content you add

You can add your own pictures (for example your own Pets, DataPlayers and wallpapers) and choose names. You keep any rights you have in them. By using them online you give us permission to store and show them to other players as part of DataMon, for as long as they are used in the game. You promise that:

• you own the content or have permission to use it;
• it isn't offensive, sexual, violent, hateful, illegal, or someone else's private information;
• it doesn't break anyone else's copyright, trademark or other rights.

Players can report pictures. We may review reported content, replace a picture with a default one, and ban a player from the Public Server for a period of time if they break these terms. If you believe content in DataMon infringes your rights, contact us and we'll look at it.

6. Content packages

DataMon can import content packages (Pets and art) that you choose. Content you import is your responsibility: only import content you have the right to use. We don't make, check or endorse content from other people's sources.

7. Privacy

How DataMon handles information is explained in the DataMon Privacy Policy.

8. Ending your use

You can stop using DataMon at any time by deleting it. We may suspend or end your access to online features if you break these terms. Your game is stored on your device, so deleting the app deletes it (a backup you made stays where you saved it).

9. No warranty

DataMon is provided "as is" and "as available". To the extent the law allows, we don't promise that the app will always work, be error-free, or that your game data will never be lost. Please use Backup in Settings to keep a copy of your game.

10. Limits on our liability

To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of game data, in-game items or currencies, arising from your use of DataMon. Because DataMon is free, our total liability to you is limited to the amount you paid us for the app (which is nothing), except where the law doesn't allow that limit.

Your consumer rights: nothing in these terms limits any rights you have that can't be excluded by law, including your rights under the Australian Consumer Law or the consumer laws of the country where you live.

11. Apple and Google

These terms are between you and us, not Apple or Google. Apple and Google are not responsible for DataMon or for support. If you got the app from the App Store, Apple's Licensed Application End User Licence Agreement also applies, and Apple and its subsidiaries may enforce these terms as a third-party beneficiary.

12. Changes to these terms

We may update these terms, for example when the app changes. We'll post the new version on this page and change the date at the top. If you keep using DataMon after a change, you accept the new terms.

13. Law

These terms are governed by the laws of the Northern Territory, Australia. This doesn't take away any protection the law of the country where you live gives you.
